1. Acceptance of Terms
By creating an account or using the Fidèle application, you agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use our services. These terms apply to all users, including customers, business owners, and employees.
2. Description of Service
Fidèle is a digital loyalty rewards platform that enables businesses to create and manage loyalty programs, and customers to earn and redeem rewards. The service includes QR code scanning for earning points/stamps, digital wallet management, reward redemption, and business analytics.
3. User Accounts
You must provide accurate and complete information when creating an account. You are responsible for maintaining the confidentiality of your account credentials. You must be at least 13 years old to create an account. Each person may only create one account. We reserve the right to suspend or terminate accounts that violate these terms.
4. User Responsibilities
You agree not to: use the service for any illegal purpose; attempt to gain unauthorized access to other accounts; share your account credentials with others; create multiple accounts to abuse loyalty programs; use automated systems to interact with the service; engage in any activity that disrupts or interferes with the service.
5. Business Owner Terms
Business owners are responsible for the accuracy of their business information and loyalty program details. Businesses must honor all legitimate reward redemptions earned through the platform. Business accounts require verification before full access is granted. Businesses must comply with all applicable local laws and regulations.
6. Loyalty Program Rules
Points and stamps earned through Fidèle have no cash value and cannot be transferred or sold. Rewards are subject to availability and may be modified or discontinued by businesses. Fraudulent earning or redemption of rewards will result in account termination. Accumulated points/stamps may expire according to individual business policies.
7. Customer Tier System
Fidèle operates a platform-wide customer tier system (Bronze, Silver, Gold, VIC) based on your annual spending across all businesses. Tier levels are calculated automatically based on total spending in Tunisian Dinars (TND) over a 365-day period: Bronze (0-500 TND), Silver (500-1,500 TND), Gold (1,500-3,000 TND), and VIC (3,000+ TND). Each tier provides an earning multiplier (Bronze: 1x, Silver: 1.25x, Gold: 1.5x, VIC: 2x) applied when earning points or stamps. Your tier resets annually from your tier period start date. Tier calculations are based on transaction amounts reported by businesses and may not reflect discounts or refunds. Tiers are assigned automatically and cannot be manually adjusted. We reserve the right to modify tier thresholds and benefits with 30 days notice.
8. Privacy and Data
We collect and process personal data as described in our Privacy Policy. Your transaction history and loyalty data are stored securely. We may share anonymized analytics with businesses to improve their services. You can request deletion of your data by contacting support.
9. Intellectual Property
The Fidèle name, logo, and all related content are protected by intellectual property laws. Users retain ownership of content they submit but grant us a license to use it for service operation. You may not copy, modify, or distribute any part of the application without permission.
10. Limitation of Liability
Fidèle is provided "as is" without warranties of any kind. We are not responsible for actions taken by businesses or other users. We are not liable for any indirect, incidental, or consequential damages. Our total liability is limited to the amount you paid for the service, if any.
11. Termination
We may terminate or suspend your account at any time for violations of these terms. You may delete your account at any time through the app settings. Upon termination, your accumulated points and stamps may be forfeited. Certain provisions of these terms survive termination.
12. Governing Law and Dispute Resolution
These terms are governed by the laws of Tunisia. Any disputes arising from these terms or your use of the service will be resolved through: first, good faith negotiation between parties; if unresolved within 30 days, mediation by a mutually agreed mediator; if mediation fails, binding arbitration in Tunisia. For EU residents, you retain the right to bring proceedings in your country of residence. Class action lawsuits are not permitted; disputes must be resolved individually.
13. Changes to Terms
We may update these terms from time to time. We will notify users of significant changes via email or in-app notification. Continued use of the service after changes constitutes acceptance. You should review these terms periodically.
